Eligibility. This SMS $5K Sweepstakes (“Sweepstakes”) is open to all natural persons who are legal residents of the 50 United States and District of Columbia, who are at least 18 years old at time of entry. Void outside the USA, in Puerto Rico, the US Virgin Islands, and other United States territories and possessions. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law.
Sponsorship. The Sweepstakes sponsor is Wantable, Inc. (“Sponsor”), located at 909 S Barclay St., Milwaukee, WI 53204. Sponsor and its respective affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, and employees, and any entity involved in the development, production, implementation, administration, judging or fulfillment of the Sweepstakes, including without limitation, the immediate family members of such individuals, are not eligible to participate. Sponsor will conduct the Sweepstakes substantially as described in these Official Rules.
Entry Period. This Sweepstakes begins on [DATE] at 12:01 AM _T and ends on [DATE] at 11:59 PM _T (“Entry Period”).
How to Enter. During the Entry Period, an eligible person may enter the Sweepstakes by either:
- opting in via the specific pop-up on Sponsor’s website to receive Sponsor’s marketing text messages and remain opted-in at the time that the winner is chosen, the first business day following the contest end date and time or
- by Mail-in Entry.
Mail-in Entry: To enter without having to opt in for text messages from Sponsor, an eligible person may submit a plain 3” x 5” card containing the person’s name, age, complete address, city, state, zip code, phone number (including area code), and email address (if any). The 3” x 5” card should be mailed in a postage-affixed sealed envelope to: “2023 SMS $5K Sweepstakes”, 909 S Barclay St., Milwaukee, WI 53204. Mail-in entries must be postmarked and received before the end of the Entry Period. No mechanically or programmatically reproduced entries are permitted. One (1) entry per envelope. Neither the Sponsor nor the Sweepstakes Administrator will verify receipt of entries for Entrants. All entries submitted become the sole property of Sponsor and will not be acknowledged or returned. Sponsor is not responsible for late, misdirected, illegible, or damaged mailed entries.
Limitations on Entries. Limit of one (1) entry per entrant during the Entry Period, regardless of method of entry. Entries received from any Entrant in excess of the above stated limitation will be void. No third party entry or entry through any sweepstakes services is permitted. Any person who attempts or otherwise encourages the entry of multiple or false contact information under multiple identities or uses any device or artifice to enter or encourage multiple or false entries, as determined by Sponsor, will be disqualified. Use of robotic entry devices is strictly prohibited.
Grand Prize. One (1) prize will be awarded, which consists of: $5,000 USD payable in one installment (the “Grand Prize”). An IRS Form 1099 will be issued to the Grand Prize winner (the “Grand Prize Winner”).
Drawing. On the first business day after the Entry Period, the Grand Prize Winner will be selected in a random drawing from all eligible entries collected during the Entry Period. The random drawing will be conducted by Sponsor or Sponsor’s designated agent, and Sponsor’s decisions and interpretations on all matters relating to the Sweepstakes and these Official Rules are final and binding in all respects. Sponsor reserves the right to disqualify any entrant or winner and may refuse to award a prize to a person who is not eligible or has violated a rule, gained unfair disadvantage in the Sweepstakes, or obtained winner status using fraudulent means. If a winner is found to be ineligible or not in compliance with Sweepstakes rules, such winner will be disqualified and an alternate winner will be awarded the prize in a separate random drawing. The Grand Prize Winner will be notified by telephone call. In the event Sponsor is not able to reach the Grand Prize Winner by telephone within seventy two (72) hours after selection, it may result in disqualification of Grand Prize Winner and an alternate winner may be selected in a random drawing at Sponsor’s discretion.
Except where prohibited by law, the potential Grand Prize Winner must sign and return, within five (5) business days of receipt, an Affidavit of Eligibility/Liability/Publicity Release and an IRS W-9 Form (the “Paperwork”) in order to claim the Grand Prize. Except where prohibited by law, Grand Prize Winner’s entry and acceptance of the Grand Prize constitutes permission for the Sweepstakes Entities to use said Grand Prize Winner’s name, photograph, likeness, statements, biographical information and voice on a worldwide basis, and in all forms of media, in perpetuity, without further compensation. If a potential Grand Prize Winner fails to return the Paperwork within five (5) days of receipt of the Paperwork, or if an Entrant is found to be ineligible, or if he/she does not comply with the Official Rules, then the potential Grand Prize Winner will be disqualified and an alternate Grand Prize Winner will be selected through a random drawing by the Sponsor or Sponsor’s designated agent from the remaining non-winning entries received during the respective Entry Period. The Grand Prize will be sent to Grand Prize Winner by U.S. mail within fourteen (14) days after the Grand Prize Winner has returned the Paperwork to the Sponsor. The Sponsor, or a third party acting on its behalf, must report the value of the Grand Prize to the Internal Revenue Service in the year the Grand Prize is received by the Grand Prize Winner and will be reported to the Grand Prize Winner and the Internal Revenue Service in the form of a Form 1099. In the event it is deemed during the verification process that a potential Grand Prize Winner does not have a unique, personal, and valid social security number for Sponsor (or any party acting on its behalf) to report the tax liability associated with acceptance of his/her Grand Prize, the potential Grand Prize Winner will be disqualified and another potential Grand Prize Winner will be selected from among the remaining eligible entries received during the respective Entry Period. Valid social security numbers will be determined by IRS requirements.
Odds. The odds of winning will depend on the number of eligible entries received, according to the eligibility requirements in the Sweepstakes.
WARNING: ANY ATTEMPT BY ANY PERSON, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH OR VANDALIZE ANY SPONSOR-OWNED WEBSITE OF MOBILE APPLICATION OR RELATED SOCIAL NETWORKING SITE, THE ENTRY PROCESS, OR OTHERWISE INTERFERE WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
General Terms: By entering this Sweepstakes, you promise to abide by the Official Rules and decisions of Sponsor, which will be final and binding in all respects. Sponsor reserves the right, at its sole discretion, to refuse, disqualify, or withdraw any entry at any time. Sponsor will not be responsible for any injury, damage or loss of any kind arising out of your participation in the Sweepstakes. YOU AGREE TO RELEASE, DISCHARGE, AND HOLD HARMLESS SPONSOR, ITS AFFILIATES, SUBSIDIARIES, EMPLOYEES, OFFICERS, DIRECTORS, AGENTS AND ASSIGNS FROM AND AGAINST ANY OR ALL CLAIMS, LOSSES, INJURIES, OR DAMAGES RESULTING FROM PARTICIPATION IN THE SWEEPSTAKES. Except where prohibited by law, by accepting prize, winner grants Sponsor a perpetual, worldwide, royalty-free license to use winner’s name, photograph, voice, and/or likeness without further authorization, compensation, r remuneration of any kind for advertising, promotion and other publicity purposes in any and all media now or hereafter known throughout the world.
Winner’s name. The name of the Grand Prize Winner is available only within the time required by law after the selection of the winner.
